Latest NewsDavid Kaminski is a partner at the law firm of Carlson & Messer LLP, a Los Angeles-based civil litigation defense firm. Mr. Kaminski�s practice specializes in the defense of collection agencies and creditors under the Fair Debt Collection Practices Act (�FDCPA�), the Fair Credit Reporting Act (�FCRA�), the Telephone Consumer Protection Act (�TCPA�) and related state and federal consumer protection statutes. He has successfully represented clients throughout the United States and practices in all state and federal courts, the 9th Circuit Court of Appeals and the California Supreme Court. Mr. Kaminski has extensive experience in multi-district and class action litigation with emphasis on the FDCPA, FCRA, TCPA, and state invasion of privacy and recording act claims. Mr. Kaminski also consults with clients on compliance and training and has developed policies and procedures to minimize the risk of liabilities for the debt collection industry. Mr. Kaminski was retained by the ACA International to coordinate the defense strategies in the TCPA class action lawsuit, Leckler v. CashCall, in which a U.S. District Court in California sought to invalidate a 2008 FCC Order which favored the debt collection industry. Mr. Kaminski successfully assisted in overturning the Court�s erroneous decision. He was also one of the coordinating defense attorneys in the mass TCPA litigation entitled, Kinder Coordinated Litigation involving over 150 TCPA lawsuits filed in the California State Courts. Mr. Kaminski has lectured on such topics as the FDCPA, the FCRA, the TCPA, recording act claims, class action strategies in State and Federal cases, trends in consumer litigation, risk management issues, and other related topics throughout the United States for the ACA International, the California Association of Collectors and its chapters, the Commercial Law League of America, the California Creditors Bar Association, the National Association of Retail Collection Attorneys, Accounts Recovery Summit, Contact Center Compliance, and DAKCS Software Systems, Inc. Mr. Kaminski has also been a long-time lecturer for the California Continuing Education of the Bar.
Kimberly Prieto leads the Payments product management team at Intuit Financial Services. In this role, Kimberly is responsible for payments strategy and support for Bill Payment, Funds Transfer, Person-to-Person Payments, My Deposit and New Account Open. In her 10-year tenure at Intuit Financial Services, Kimberly has worked in the Corporate Strategy group, focusing on a number of initiatives, including primary research into the drivers of online banking and bill payment adoption, and has been the product manager for the companys bill payment products. Before joining the company, Kimberly worked for Deutsche Bank, focusing on the development of foreign exchange trading and back-office applications. Kimberly received her MBA from New York University.
Ms. Cohen is General Counsel at LCS Receivables Management, LLC and its affiliated companies with business relating to secured and unsecured collections, servicing and default management, collection litigation, and debt acquisitionand sales. As General Counsel for the LCS Receivables Management companies, Ms. Cohen manages all regulatory and compliance affairs including monitoring and advising on the Fair Debt Collection Practices Act, Telephone ConsumerProtection Act of 1991, Fair Credit Reporting Act, and the Dodd-Frank Act. In addition, Ms. Cohen is responsible for managing all corporate legal matters as they relate to regulatory compliance including debt collection, servicingand origination licensure, contract compliance, intellectual property, litigation and corporate governance.Ms. Cohen brings with her more than eight years of experience and an impressive educational background. Prior to joining LCS Receivables Management, Ms. Cohen worked in private practice at an international law firm where she served as an attorney specializing in mergers and acquisitions, corporate law and real estate. She also served as Vice President and General Counsel for an international franchise chain, and as a litigator with an emphasis on employment law. Ms. Cohen received her J.D. from the University of Colorado with Deans List Honors, and her B.A. from the University of Arizona, cum laude.Ms. Cohen is involved in various financial services organizations and committees and is a lecturer on collection regulation and compliance.
